Terms and Conditions For Use of Website:

1. The User is a person residing outside Brazil, who is willing to pursue medical or dental treatment in Brazil, and, as a result, needed to arrange for her/his travel to and stay in Brazil, as well as the travel and stay of accompanying person(s). In addition, User may or may not have intended to engage in leisure activities during his travel in Brazil.

2. In order to facilitate his travel to and treatment in Brazil, User will use NYX’s Website for checking the available information on doctors, dentists and treating institutions, as well as on tourism destinations.

3. In addition to using NYX’s website, User shall make her/his own investigation on doctors, dentists or treating institutions she/he intended to contract for the treatment.

4. Through NYX’s Website, User will be able to contact doctors, dentists or institutions in regard to her/his treatment. Where applicable, User can submit to doctors, dentists or institutions her/his examinations or diagnostic reports.

5. After contacting doctors, dentists or institutions, submitting examinations or diagnostic reports, and receiving information to its satisfaction, User will be able to select the treating institution and the treating doctor(s) to carry out her/his treatment. User will define, jointly with the treating institution and the treating doctor(s), the characteristics and specifics of the treatment.

6. By using the Website, User will select dates, destinations, and hotels for travel in Brazil. Based on such information and on the treatment chosen by User, NYX will form the appropriate Medical Tourism Package and will provide a quotation for it, including all the elements selected by User.

7. User shall review the information of the Medical Tourism Package. By using NYX’s website, User will be able to change any element of the Medical Tourism Package and to request other quotations for different dates or from different doctors or institutions.

8. NYX, potential treating institutions, potential treating doctors and the travel agency will not charge User for obtaining information for her/his treatment or medical tourism package, for contacting treating institutions and/or doctors, and for obtaining quotations from NYX in accordance with the foregoing.

9. User will be charged only for her/his Medical Tourism Package when she/he presses the “confirmation” button to the Agreement made available at the Website, by means of which User will contract and become bound to the following agreements:

(a) the Medical Tourism Package Agreement at the Amount, and this Terms and Conditions;

(b) the Treatment Agreement;

(c) the Professional Service Agreement;

(d) the Travel Agreement.

10. The above agreements will be made available to User along with any quotation presented by NYX. By pressing the “confirmation” button, User will be in accordance with the quotation presented, including the financial terms and the scope of the services and treatment. After “confirmation” button is pressed, reimbursement shall be subject to cancellation rules provided for under Medical Tourism Package Agreement terms and conditions.

11. NYX does not control or operate any treating institution, doctor(s), travel agency or insurer, nor does it operate or control any facility or service provided by such persons or entities. User is willing to travel to Brazil for tourism and treatment, and NYX solely provide services of facilitating User’s travel.

12. NYX does not provide, and is not licensed under Brazilian law to provide treatment, analysis, advice or any other medical or dental service. The medical or dental services will be provided to the User directly from the treating institution and treating doctor(s) to be chosen by User.

13. As a result, NYX cannot be made liable or responsible for any delay, default, failure, improper services or deficiency in services provided by the treating institution, the doctor(s), the travel agency and/or the insurer, and/or for any injury, sickness, accident, discomfort, death, loss or damage of any kind whatsoever which may arise due to any act of negligence, deficiency or default in services, of the management or employees of the treating institution, the doctor(s), the travel agency and/or the insurer. User hereby acknowledges that the choice of the treating institution and the doctor will depend solely on its own judgment.
